1. Introduction
Welcome to Pixel Lounge ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our gaming café services, website, and mobile applications (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the Terms, you may not access the Services.
2. Eligibility
You must be at least 13 years of age to use our Services. If you are under 18 years of age, you may only use our Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. We reserve the right to request proof of age at any time.
3. User Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device.
You agree to accept responsibility for all activities that occur under your account or password. If you believe someone has accessed your account without authorization, please contact us immediately.
4. Gaming Café Rules
While using our physical gaming café locations, you agree to:
- Treat all equipment with care and respect
- Treat staff and other customers with respect
- Not consume outside food or beverages unless explicitly permitted
- Not engage in any illegal activities
- Not install unauthorized software on our computers
- Not attempt to circumvent any security measures
- Adhere to time limits associated with your purchased gaming sessions
- Follow all posted rules and staff instructions
We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion if these rules are violated.
5. Bookings and Reservations
Reservations for gaming stations, VR experiences, or private rooms may require a deposit or full payment in advance. Cancellations must be made at least 24 hours before the scheduled time to be eligible for a refund.
No-shows or late cancellations may result in forfeiture of your payment or deposit. We reserve the right to release your reservation if you are more than 15 minutes late without notifying us.
6. Membership Programs
Membership benefits are subject to change with reasonable notice. Memberships are non-transferable and cannot be shared between multiple individuals.
Monthly membership fees are charged automatically until cancelled. You may cancel your membership at any time, but refunds will not be issued for partial membership periods.
7. Tournaments and Events
By registering for tournaments or events, you agree to follow all rules specific to that competition. We reserve the right to disqualify participants for rule violations, unsportsmanlike conduct, or other reasons at our discretion.
Tournament prizes are awarded as described in the specific event rules. Winners are responsible for any applicable taxes on prizes.
8. Intellectual Property
All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Pixel Lounge, our licensors, or other content suppliers and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
9. User Content
By posting content on our website, social media, or within our facilities, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
You represent and warrant that you own or control all rights to the content you post, that the content is accurate, and that use of your content does not violate these Terms and will not cause injury to any person or entity.
10. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Violating any laws, rules, or regulations
- Interfering with security features of our Services
- Using our Services for any illegal or unauthorized purpose
- Engaging in harassment, abuse, or harmful behavior toward others
- Attempting to gain unauthorized access to our systems or networks
- Engaging in any activity that disrupts or interferes with our Services
- Creating multiple accounts for abusive purposes
11. Limitation of Liability
To the maximum extent permitted by applicable law, Pixel Lounge and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Services
- Any conduct or content of any third party on the Services
- Any content obtained from the Services
- Unauthorized access, use, or alteration of your transmissions or content
12. Indemnification
You agree to defend, indemnify, and hold harmless Pixel Lounge, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.
13. Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease.
14. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of changes by posting the updated Terms on this page with a new effective date. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.
